2. Applicant receives a proper Final Office Action with a shortened statutory period for reply of 3 months.

Applicant submits a proper reply in less than 2 months. The examiner mails an advisory action

before the end of the shortened 3 month statutory reply period. The practitioner wishes to request

an extension of time for reply. When is the start of the extension of time measured from?


A. The extension of time is measured from the end of the 3 month reply period.

B. The extension of time is measured from the mailing date of the Advisory Action.

C. The extension of time is measured from the practitioner's receipt of the Advisory Action

or the end of the 3 month reply period, whichever is earlier.

D. The extension of time is measured from the practitioner's receipt of the Advisory Action

or the end of the 3 month reply period, whichever is later.

E. The extension of time is measured from the Office receipt of the practitioner's reply

plus 2 months but may not be extended beyond the 6 month statutory period.
